A Hometown Lawyer with a National Reputation for Success
Tim has been a trial attorney in Memphis for 30 years. Because of his success and expertise, Tim is a nationally recognized birth injury lawyer who receives referrals from lawyers across the United States.
Over the years, Tim has tried more than 100 jury trials to a final verdict. A jury in Shelby County awarded Tim’s client what was then the highest verdict very in a birth injury case. A jury in Mississippi awarded Tim’s client $12 Million Dollars, and it stands to this day as the highest birth injury verdict in the Mississippi Delta.
Because of Tim’s reputation and skill as a trial lawyer, many insurance companies decide to settle with his clients rather than take a chance in the courtroom. In those cases where the insurance company will not pay the a fair amount, Tim and his team are always ready to take their cases to trial, instead of just taking what little the insurance company is willing to pay without a fight.
Tim has learned through the years that if the insurance companies think you are a “settlement lawyer” and not someone who is willing to fight them, they will only pay a minimal “settlement” amount. On the other hand, if you are a fighter who has taken on the insurance companies and won, time and time again, the insurance companies likely will offer more money and offer it sooner. Tim has always been a fighter, and is not afraid to go up against even the biggest insurance company or corporation.
Tim is licensed in Tennessee, Arkansas, Mississippi and Florida. He has had several cases before the United States Supreme Court, and he is admitted to practice in all courts in Tennessee, Mississippi and Arkansas. He is also admitted to practice before the United States Court of Appeals for the Sixth Circuit and the United States Court of Appeals for the Eighth Circuit.
Many lawyers refer difficult cases to Tim because of his experience and proven track record. Tim has successfully represented clients who have been injured by:
- defective heart stent devices
- defective and dangerous drugs
- defective hip and knee implants
- dangerous and defective industrial machines and equipment
In one situation, Tim was asked by another lawyer to try a medical negligence case. The call for help came on a Friday with the trial scheduled to start the following Monday. Tim and his team worked non-stop through the weekend and for the next two weeks tried the case to a jury in Shelby County. Although the insurance company said they would not pay a single penny, the jury awarded the client $750,000.00.
Tim has been involved as counsel in many mass tort cases. This past year, Tim Holton was appointed as class counsel in one of the largest class action lawsuits in the State of Arkansas.
In all his years of practice, Tim has never represented an insurance company, or a Defendant in a civil lawsuit. He has always represented the injured person, never the person who caused the injuries.
On a National level, Tim is:
- Certified as a Civil Trial Specialist by the National Board of Trial Advocates
- Certified as a Medical Malpractice Specialist by the Association of Professional Liability Attorneys
- An Advocate in the American Board of Trial Advocates
- A Member of the Million Dollar Advocate Forum
- A Member of the Multi-Million Dollar Advocate Forum
With an undergraduate degree in Journalism from Memphis State University, Tim attended the University of Memphis School of law, graduating in 1985. Tim and Angie, his wife of 35 years, have two sons, John and Adam, who both work with Tim at the Holton Law Firm. They have been blessed with three wonderful grandchildren, Jack, Avery and Vincent.
